C. Once a Proper Bona Fide Infringement Notification is Received

Upon receiving a proper notice of infringement, it is our policy to:

  1. Remove or disable access to the allegedly infringing Content;
  2. Notify the user who posted the Content (if applicable) that the Content has been removed or disabled due to an infringement claim; and
  3. Take further action as necessary, including terminating accounts of repeat infringers in accordance with our policy.

D. Procedure to Supply a Counter-Notice

If you believe that the Content that was removed (or to which access was disabled) is not infringing, or if you believe you have the right to post and use such Content (e.g., through a license, fair use, or other legal permission), you may send a counter-notice to our Designated Agent with the following information:

  2. Statement of Good Faith Belief: A statement by you, made under penalty of perjury, that you have a good faith belief that the Content was removed or disabled as a result of a mistake or misidentification.

If our Designated Agent receives a valid counter-notice, we will:

  • Send a copy of the counter-notice to the original complaining party, informing them that we may replace the removed Content or cease disabling access to it within 10 business days.
  • Unless the rights holder files an action seeking a court order against the user, the removed Content may be replaced, or access to it restored, within 10 to 14 business days after receipt of the counter-notice, at our discretion.

E. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We may also, at our sole discretion, limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is repeat infringement.


F. Liability for Misrepresentation

Please note that under Section 512(f) of the DMCA, any person who knowingly misrepresents that Content or activity is infringing may be subject to liability for damages, including costs and attorney’s fees. Similarly, if a counter-notice is filed with false information, the filer may also be liable for damages. We encourage all parties to ensure the accuracy of their claims or counter-notices.
